1. Acceptance of Terms
By accessing, browsing, or using PredictEngine ("the Service", "Platform", "we", "us", or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must immediately cease using the Service.
These Terms constitute a legally binding agreement between you and PredictEngine. Your continued use of the Service constitutes your acceptance of any modifications to these Terms.
2. Eligibility
You represent and warrant that:
- You are at least 18 years of age or the age of legal majority in your jurisdiction
- You have the legal capacity to enter into binding contracts
- You are not located in, or a citizen or resident of, any jurisdiction where use of prediction markets or cryptocurrency is prohibited
- You are not on any sanctions list or prohibited from engaging in financial transactions
- Your use of the Service does not violate any applicable law or regulation
3. Description of Service
PredictEngine provides software tools that allow users to create and deploy automated trading strategies ("bots") on third-party prediction markets, including but not limited to Polymarket and Opinion. The Service includes:
- Custodial wallet creation and management (Safe smart contract wallets on Polygon, EOA wallets on BNB Chain for Opinion integration)
- AI-assisted trading strategy generation powered by large language models (Claude / Anthropic)
- Automated trade execution based on user-defined parameters
- Portfolio tracking, analytics, and profit-and-loss reporting
- Leverage trading on prediction market outcomes (synthetic product offered by PredictEngine)
- Sports and event market trading, including an automated sports value-betting bot
- Sports arbitrage scanning across Polymarket, ESPN, and DraftKings
- Cross-platform arbitrage bots that trade simultaneously on Polymarket and Opinion
- Market making tools and opportunity scanner
- Copy trading functionality that replicates third-party trader activity
- A bot strategy marketplace where users may share or copy strategies
- Manual trading interface for direct order placement
- Cross-chain deposits via Li.Fi bridge integration
- Discord trading bot (prefix commands, bot management, manual trading) with a 2% platform fee on trades
- Telegram integrations including an admin alerts bot and a user-facing wallet tracker bot
- News aggregation, market mover feeds, whale alerts, and AI-generated market analysis
- Public leaderboards, referral program, and a developer / partner API
- Engagement features including streaks, simulation balances, phantom P&L displays, deposit bonuses, A/B tests, and percentile rankings
We do not operate a prediction market. We are a software provider that interfaces with third-party platforms. We have no control over the underlying markets, their rules, or their operation, except with respect to our proprietary leverage product and our internal engagement / simulation features, which are operated directly by PredictEngine.
4. CRITICAL RISK DISCLOSURE
BY USING THIS SERVICE, YOU ACKNOWLEDGE AND ACCEPT THE FOLLOWING RISKS:
- Total Loss of Funds: You may lose 100% of all funds deposited or traded through the Service. Trading on prediction markets is highly speculative and risky.
- No Guarantees: Past performance of any trading strategy does not guarantee future results. All performance metrics are historical and may not be replicated.
- Software Failures: Automated trading bots may malfunction, execute incorrect trades, fail to execute trades, or behave unexpectedly due to bugs, network issues, or market conditions.
- Market Risks: Prediction markets can experience extreme volatility, illiquidity, manipulation, or sudden closures. Markets may resolve unexpectedly or incorrectly.
- Smart Contract Risks: The underlying blockchain protocols and smart contracts may contain bugs, vulnerabilities, or be subject to hacks, exploits, or failures.
- Regulatory Risks: The legal status of prediction markets and cryptocurrencies varies by jurisdiction and may change without notice, potentially affecting your ability to use the Service or access your funds.
- Counterparty Risks: Third-party platforms (including Polymarket) may become insolvent, be hacked, freeze accounts, or cease operations without notice.
- Technology Risks: Loss of private keys, wallet compromise, phishing attacks, or other security breaches may result in permanent loss of funds.
5. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT OF THIRD-PARTY RIGHTS
- ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION
- UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION
- CORRECTION OF DEFECTS OR ERRORS
- FREEDOM FROM VIRUSES OR HARMFUL COMPONENTS
WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY TRADING STRATEGY WILL BE PROFITABLE.
6. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
PREDICTENGINE, ITS OPERATORS, OWNERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or anticipated savings
- Loss of data or digital assets
- Trading losses of any kind
- Loss arising from unauthorized access to your account or wallet
- Loss arising from hacks, exploits, or security breaches
- Loss arising from service interruptions or downtime
- Loss arising from errors, bugs, or malfunctions in the software
- Loss arising from third-party actions or platform failures
- Any other losses related to your use of the Service
THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
7. Indemnification
You agree to indemnify, defend, and hold harmless PredictEngine, its operators, owners, employees, agents, affiliates, licensors, and service providers from and against any and all claims, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Your trading activities and any resulting losses
- Any claim that your use of the Service caused damage to a third party
- Your failure to secure your account, wallet, or private keys
8. Wallets and Self-Custody
You own and control your wallets and the funds within them. PredictEngine is a software platform that operates wallets you own in response to actions you specifically authorize. We do not take legal custody of your funds, do not hold pooled or commingled balances, and do not have discretionary authority to move your assets.
- Your primary trading wallet is a Safe (Gnosis Safe) smart contract wallet deployed on the Polygon network, owned by you. For users of the cross-platform arbitrage feature, a secondary externally-owned-account (EOA) wallet is provisioned on BNB Chain for use with the Opinion platform. Both wallets are deployed to addresses uniquely associated with your account.
- Private keys are generated on your behalf and encrypted at rest using AES-based encryption. You may export your private keys at any time via your wallet settings, after which you retain full and independent control of your wallet outside the platform.
- All transactions on your wallet are executed only in response to actions you specifically authorize: bot configurations you create, manual trades you submit, withdrawals you initiate, leverage positions you open or close, and cross-platform bridge operations you enable.
- Certain gasless operations (such as Safe deployment and Polymarket trading approvals) may be executed through the Polymarket Builder Relayer on your behalf, but only for the specific operations you authorize.
- When you use the cross-platform arbitrage feature, funds may be bridged between your Polymarket wallet (Polygon) and Opinion wallet (BNB Chain) via Li.Fi. Bridge delays, partial fills, slippage, or failures may result in loss of funds or stuck balances. You accept these risks.
- Funds remain in your individually owned wallet at all times. We do not maintain an omnibus account, custodial pool, or any commingled user balance.
- We cannot recover lost or stolen credentials, exported keys, or wallets. We cannot reverse or modify transactions once broadcast to a blockchain.
- You are solely responsible for the security of your PredictEngine account credentials, any exported keys, and any devices you use to access the Service.
Not a Money Transmitter. PredictEngine does not transmit value on behalf of users, does not custody fiat or pooled cryptocurrency, and does not facilitate transfers of value between users. Our service is limited to operating software (including automated trading bots) on wallets that you own and control, in response to your specific instructions. Funds move directly between your wallet and third-party prediction-market venues (such as Polymarket and Opinion) on the underlying blockchain; they do not pass through any PredictEngine-owned account.
IF YOUR ACCOUNT CREDENTIALS, EXPORTED PRIVATE KEYS, OR DEVICES ARE COMPROMISED, YOUR FUNDS MAY BE PERMANENTLY LOST. WE HAVE NO ABILITY TO RECOVER FUNDS STOLEN FROM A COMPROMISED WALLET OR ACCOUNT.
9. No Financial or Legal Advice
Nothing on PredictEngine or in communications from us constitutes:
- Financial, investment, or trading advice
- Legal or tax advice
- A recommendation to buy, sell, or hold any asset
- A solicitation or offer to buy or sell securities
All trading strategies, bot configurations, and AI-generated content are provided for informational and educational purposes only. You should consult with qualified professionals before making any financial decisions.
10. Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- Securing your private keys and wallet
- Using strong, unique passwords
- Enabling two-factor authentication where available
- Monitoring your account for unauthorized activity
- Immediately notifying us of any security breaches
We are not liable for any losses resulting from unauthorized access to your account due to your failure to maintain security.
11. Service Availability
We do not guarantee that the Service will be available at all times. The Service may be interrupted for maintenance, updates, or due to technical issues. We may modify, suspend, or discontinue the Service at any time without notice.
We are not liable for any losses resulting from service interruptions, including but not limited to missed trades, inability to close positions, or market movements during downtime.
12. NO REFUNDS POLICY
ALL PURCHASES AND PAYMENTS ARE FINAL. WE DO NOT OFFER REFUNDS UNDER ANY CIRCUMSTANCES.
This includes, but is not limited to:
- Credit purchases
- Subscription fees
- Trading losses
- Service fees
- Any other payments made to PredictEngine
By making any purchase or payment, you acknowledge and agree that you will not be entitled to a refund for any reason, including dissatisfaction with the Service, trading losses, technical issues, or termination of your account.
13. LEVERAGE TRADING - ADDITIONAL RISK DISCLOSURE
LEVERAGE TRADING CARRIES SUBSTANTIALLY HIGHER RISK THAN STANDARD TRADING. BY USING THE LEVERAGE TRADING FEATURE, YOU ACKNOWLEDGE AND AGREE TO ALL OF THE FOLLOWING:
- Amplified Losses: Leverage amplifies both gains AND losses. With 2x leverage, a price movement against your position results in DOUBLE the loss compared to an unleveraged position. You can lose your ENTIRE collateral rapidly.
- Automatic Liquidation: If the market moves against your position beyond the liquidation threshold, your position will be automatically closed ("liquidated") and you will lose ALL of your collateral for that position. Liquidation is final and irreversible. No refunds or compensation will be provided for liquidated positions.
- Liquidation Threshold: Liquidation thresholds are set by PredictEngine and may vary by market, direction, and entry price. PredictEngine reserves the right to modify liquidation thresholds at any time without prior notice. Tighter thresholds mean positions may be liquidated sooner.
- No Guaranteed Execution: During periods of extreme volatility, network congestion, or system load, liquidations and trade executions may be delayed. Price slippage may occur. You may receive a worse price than displayed.
- Spread and Fees: Leverage positions are subject to entry/exit spreads and periodic funding fees. These costs reduce your profit and increase your effective loss. Funding fees accrue continuously while your position is open.
- Market-Specific Limits: PredictEngine may impose market-specific limits on maximum collateral, leverage ratios, and liquidation thresholds. These limits may change without notice based on market conditions, platform exposure, or risk management needs.
- Platform as Counterparty: In leverage trading, PredictEngine acts as the counterparty to your position. This means that when you profit, the platform pays you, and when you lose, the platform retains your collateral. This creates an inherent conflict of interest that you acknowledge and accept.
- Not a Regulated Financial Product: Leverage trading on PredictEngine is not a regulated financial product. It is not a futures contract, options contract, CFD, or any other regulated derivative. No regulatory body oversees or guarantees this activity.
- Price Data: Prices displayed are derived from third-party sources (including Polymarket orderbooks) and may differ from prices on other platforms. PredictEngine does not guarantee the accuracy, timeliness, or reliability of price data.
14. LEVERAGE TRADING - ASSUMPTION OF RISK
BY OPENING ANY LEVERAGED POSITION, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
- You understand how leverage, liquidation, spreads, and funding fees work
- You accept the risk of losing 100% of your collateral on any position
- You will not hold PredictEngine liable for any losses from leverage trading, including losses from liquidations, price slippage, delayed executions, incorrect price data, system outages, or any other cause
- You are trading with funds you can afford to lose entirely
- You have not relied on any representation, statement, or guarantee by PredictEngine regarding the profitability or safety of leverage trading
- PredictEngine may modify, suspend, or discontinue the leverage trading feature at any time, including closing open positions, without prior notice
- In the event of a system error, exploit, or abnormal market condition, PredictEngine reserves the right to void, reverse, or modify trades and positions
- PredictEngine's total liability for any leverage trading claim shall not exceed the collateral amount of the specific position in question
15. SPORTS AND EVENT MARKET TRADING
When trading on sports or event-based markets (including but not limited to NFL, NBA, NHL, soccer, and other sporting events), you additionally acknowledge:
- Event Outcome Risk: Sports and event market outcomes are determined by third-party resolution sources. PredictEngine has no control over event outcomes, market resolution, or the accuracy of resolution sources.
- Rapid Price Movement: Sports markets can experience sudden, extreme price movements during live events (goals, touchdowns, injuries, etc.). Leveraged positions on live events carry exceptional risk of rapid liquidation.
- Resolution Disputes: Markets may resolve in ways that differ from your expectations. Resolution is determined by the underlying platform (e.g., Polymarket) and PredictEngine has no control over or liability for resolution decisions.
- Not Sports Betting: PredictEngine is a software platform for trading on prediction markets. We do not operate a sportsbook, accept bets, or set odds. Any references to "betting" are colloquial and do not imply that we are a licensed betting operator.
- Gambling Laws: You are solely responsible for ensuring that your use of prediction markets and leverage trading complies with all applicable gambling, betting, and trading laws in your jurisdiction.
16. CROSS-PLATFORM ARBITRAGE
The cross-platform arbitrage feature allows bots to open offsetting positions on Polymarket (Polygon) and Opinion (BNB Chain) simultaneously. By enabling this feature, you acknowledge and accept the following additional risks:
- Dual-Wallet Bridging: When you start a cross-platform bot, approximately half of the allocated funds are automatically bridged from your Polygon wallet to your Opinion (BNB Chain) wallet via Li.Fi. When you stop the bot, funds may be bridged back. Bridge transactions are subject to fees, slippage, delays, and potential failure. PredictEngine is not liable for losses arising from bridge failures, partial fills, or routing errors.
- Resolution Divergence: Polymarket and Opinion are separate platforms with independent resolution mechanisms. Events may resolve differently, at different times, or with different outcomes on each platform. This may eliminate or reverse the arbitrage.
- Platform-Specific Risk: Opinion is a separate third-party platform with its own smart contract risk, operational risk, and counterparty risk. PredictEngine does not control Opinion and is not responsible for its operation, insolvency, or outages.
- Execution Asynchrony: Orders on Polymarket and Opinion are executed independently. One leg may fill while the other does not, leaving you exposed to directional risk. PredictEngine does not guarantee that both legs will fill simultaneously or at expected prices.
- Opinion Wallet Visibility: Your Opinion wallet is managed by PredictEngine and may not be surfaced in the primary dashboard. You authorize PredictEngine to operate this wallet on your behalf for cross-platform arbitrage purposes.
17. MARKET MAKING
PredictEngine offers market making tools that allow users to place resting orders on both sides of a market to capture the bid-ask spread. By using these tools, you acknowledge:
- Adverse Selection: Market makers are subject to adverse selection, where informed traders pick off stale quotes. You may suffer losses even if your bot operates correctly.
- Inventory Risk: Market making positions accumulate inventory that is exposed to directional price movements. You may hold unwanted exposure if one side of your book fills disproportionately.
- Opportunity Scanner Accuracy: The MM opportunity scanner surfaces suggested markets based on heuristics. It does not guarantee profitability or that liquidity will be captured.
- No Designated Market Maker Status: You are not a registered or designated market maker. PredictEngine does not provide rebates, order flow agreements, or special privileges from Polymarket or any other venue.
18. COPY TRADING AND MARKETPLACE
PredictEngine enables users to copy trades from third-party traders (including public Polymarket addresses) and to publish, share, or copy bot strategies via the marketplace. By using these features, you acknowledge:
- No Endorsement: PredictEngine does not endorse, verify, or audit the strategies or performance of any trader or marketplace listing. Displayed performance data may be incomplete, historical, or unrepresentative.
- Delayed Replication: Copy trades are executed after the source trader's transaction is observed on-chain. Slippage, price movement, and network latency may cause your fill to differ materially from the original trader's fill.
- Strategy Author Risk: Marketplace strategies are authored by third-party users and may contain bugs, unsound logic, or undisclosed risks. You are solely responsible for reviewing and accepting any strategy before deploying it.
- Publishing to Marketplace: If you publish a strategy, you grant PredictEngine a non-exclusive, perpetual, royalty-free license to display, distribute, and allow other users to copy the strategy. You represent that you have the right to publish the strategy and that it does not contain malicious code.
- No Guarantee of Performance: Past performance of a copied trader or strategy does not guarantee future results. You may lose all copied capital.
19. DISCORD TRADING BOT
PredictEngine operates a Discord bot that allows users to interact with the Service via Discord commands (prefix pe). By using the Discord bot, you acknowledge:
- Account Auto-Provisioning: The first time you use the Discord bot, a PredictEngine account and custodial wallet are automatically created for you and linked to your Discord user ID.
- Discord Trading Fee: A 2% platform fee is applied to every buy and sell executed through the Discord bot. This fee is in addition to any network gas fees and any third-party platform fees.
- Server-Level Settings: Server owners and designated server admins may configure bot-wide settings for their server (including credits mode). These settings apply to all users of the Discord bot within that server.
- No Custody Advice via Discord: Commands issued in a Discord DM or channel are processed automatically. PredictEngine does not and cannot verify the identity of the Discord account operator. You are responsible for the security of your Discord account.
- Discord Platform Risk: Discord is a third-party service with its own terms, outages, and risks. PredictEngine is not responsible for any Discord outage, suspension, or failure that prevents you from accessing or controlling your bots or wallet.
- Data Transmission: Messages sent to the Discord bot are processed on our servers and may be logged for support, security, and fraud prevention.
20. TELEGRAM INTEGRATIONS
PredictEngine operates Telegram bots including an administrative alert bot and a user-facing wallet tracker bot. By using these integrations, you acknowledge:
- Third-Party Platform: Telegram is a third-party service and is subject to its own terms, privacy policy, and operational risks.
- Wallet Tracking Data: The wallet tracker bot displays on-chain data that is publicly available. We do not guarantee the accuracy, completeness, or timeliness of this data.
- Notifications Are Not Advice: Alerts, whale notifications, odds notifications, and market updates delivered via Telegram are informational only and do not constitute investment, financial, legal, or tax advice.
- No Trading From Telegram: PredictEngine does not currently execute trades from Telegram. Any future Telegram-based trading features will be subject to these Terms and any additional product-specific terms in effect at the time.
21. AI-GENERATED STRATEGIES AND CONTENT
PredictEngine uses large language models (including models provided by Anthropic) to generate trading strategies, market analysis, chat responses, news summaries, and social media content. By using these AI features, you acknowledge:
- AI Output Is Not Advice: AI-generated strategies, suggestions, and commentary are provided "as is" for informational purposes only. They are not investment, trading, legal, or tax advice.
- Hallucination Risk: AI models may produce output that is inaccurate, incomplete, outdated, biased, or fabricated. You are solely responsible for reviewing, testing, and validating any AI-generated strategy before deploying it.
- Sandboxed Execution: AI-generated strategies run in a sandboxed Python environment with a restricted set of built-in functions. PredictEngine does not guarantee that the sandbox is bug-free or immune to exploitation.
- Data Processing: Prompts, chat messages, and related metadata may be transmitted to third-party AI providers (including Anthropic) for processing, subject to their respective terms and privacy policies.
- No Liability for AI Losses: PredictEngine is not liable for any trading losses, opportunity costs, or other damages arising from use of AI-generated strategies, analysis, or recommendations.
22. Subscription Plans and Credits
PredictEngine offers subscription plans (including a Pro tier and an Unlimited tier) and a credits system for AI-powered features such as strategy chat, strategy generation, and certain bot types.
- Subscription prices, billing cycles, included credits, and feature gating are set by PredictEngine and may change at any time. Changes do not retroactively alter subscriptions already paid for during the active billing period.
- Credits are non-transferable and have no cash value. Unused credits may expire per the credit package terms in effect at purchase.
- Subscriptions may be billed in fiat or cryptocurrency. Payments are final. Refer to Section 12 (No Refunds).
- PredictEngine may grant, revoke, or adjust credits or subscription status in its sole discretion for abuse prevention, fraud mitigation, promotional programs, or compensation for service disruptions.
- Certain features (such as the Discord bot) operate on a fee-per-trade basis and may not require credits or subscription status.
23. Referral Program
PredictEngine offers a referral program through which users may earn a percentage of platform fees generated by users they refer.
- Default and per-user referral commission rates are set by PredictEngine and may be modified at any time.
- Referral earnings accrue only on qualifying fee events. Fees refunded, reversed, or waived do not generate referral earnings.
- Self-referrals, wash activity, coordinated multi-account abuse, and any attempt to manipulate the referral program are prohibited. PredictEngine may void referral earnings and terminate offending accounts.
- Referral earnings may be paid in USDC, credits, or other tokens at PredictEngine's discretion. Payment cadence is not guaranteed.
24. Engagement Features and Simulated Balances
The Service includes gamification and engagement features including streaks, percentile rankings, account completeness meters, deposit bonuses, A/B tested experiences, near-miss indicators, phantom P&L displays, and time-limited simulated balances.
- Simulated Balances Are Not Real Funds: Simulated or "paper" balances displayed in the Service do not represent deposits, are not redeemable, and have no cash value. They may expire, reset, or be revoked at any time.
- Phantom P&L: Certain displayed performance figures may include projected, estimated, or gamified values that are not based solely on realized on-chain P&L. Only values in your actual wallet represent real funds.
- Deposit Bonuses: Deposit bonuses are promotional credits awarded at our discretion during active bonus windows. Bonuses may be credited, adjusted, or clawed back in cases of abuse, reversed deposits, or chargebacks.
- A/B Testing: You may be assigned to experimental variants of features, pricing, or user flows. PredictEngine does not guarantee that all users see identical features, prices, or promotions at any given time.
- Leaderboard and Public Profile: You may opt in to public leaderboards and profile displays. Data shown publicly is governed by your opt-in settings. PredictEngine may display limited non-personal statistics (such as win rate, P&L, and bot performance) on public leaderboards.
25. Developer and Partner API
PredictEngine may offer developer and partner APIs for programmatic access to market data, account features, or trading functionality. Use of any such API is subject to the Terms, applicable API keys, rate limits, usage tiers, and any additional developer terms published at the time of access. API keys are confidential and must not be shared. PredictEngine may throttle, revoke, or modify API access at any time.
26. Fees
PredictEngine charges the following platform fees, which may change without notice. The fee schedule in effect at the time of the applicable action controls. Current fees include, without limitation:
- Deposit fee of approximately 1% on incoming deposits
- Withdrawal fee of approximately 2% on outgoing withdrawals
- Trading fee of approximately 0.2% per bot trade (buys and sells), with a reduced fee of approximately 0.05% for arbitrage bot trades
- Discord trading fee of 2% on buys and sells executed through the Discord bot
- Leverage-specific entry/exit spreads and periodic funding fees, as described in Section 13
- Gas fees paid to the underlying blockchain networks, which are not retained by PredictEngine
- Third-party platform fees (including Polymarket and Opinion) that are assessed independently of PredictEngine
Fees are deducted automatically at the time of the applicable action and are non-refundable. Fees may be applied in native assets (e.g., POL for deposit fees, USDC for trading fees).
27. Third-Party Services
The Service integrates with third-party platforms and services, including but not limited to Polymarket, Opinion, Polygon blockchain, BNB Chain, Anthropic (Claude), Li.Fi (cross-chain bridge), Alchemy (RPC and blockchain data), Supabase (authentication and database), ChangeNOW (crypto swaps), Resend (email), Cloudinary (media hosting), Twitter/X, Discord, Telegram, ESPN (sports data), DraftKings (odds data), ElevenLabs (text-to-speech), D-ID (AI avatars), Creatomate (video), and Make.com (webhooks). We are not responsible for:
- The availability, accuracy, or reliability of third-party services
- Changes to third-party terms, conditions, pricing, or APIs
- Actions taken by third-party platforms, including account freezes, fund seizures, or trade reversals
- Security breaches, data loss, or operational failures of third-party services
- Outcomes, resolutions, or decisions made by third-party platforms
28. Prohibited Uses
You agree not to:
- Use the Service for any illegal purpose
- Violate any applicable laws or regulations
- Attempt to manipulate markets or engage in fraudulent activity
- Interfere with or disrupt the Service
- Attempt to gain unauthorized access to systems or data
- Use the Service on behalf of sanctioned entities or persons
- Reverse engineer, decompile, or disassemble the Service
29. Termination
We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination:
- Your right to use the Service will immediately cease
- You remain responsible for any outstanding obligations
- You retain access to your wallet and funds per our withdrawal policy
- These Terms continue to apply to your prior use of the Service
30. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
31. Governing Law & Disputes
These Terms and any dispute arising out of or relating to these Terms or your use of the Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules then in effect. The arbitration shall be conducted before a single arbitrator, in Wilmington, Delaware (or by remote / telephonic means at the parties' agreement), in the English language. Judgment on the arbitral award may be entered in any court of competent jurisdiction.
YOU AND PREDICTENGINE WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS, CLASS-WIDE ARBITRATION, OR REPRESENTATIVE PROCEEDINGS. CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR COLLECTIVE ACTION.
Notwithstanding the foregoing: (a) claims for amounts under USD $10,000 may, at the claimant's election, be brought in small-claims court in the jurisdiction where the claimant resides; (b) either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property, trade secrets, or to enforce confidentiality obligations pending arbitration; and (c) nothing in this Section prevents you from filing a complaint with any applicable governmental authority, including consumer protection or data protection authorities.
32. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
33. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PredictEngine regarding the Service and supersede all prior agreements.
35. DMCA / Copyright Policy
PredictEngine respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. The Service permits limited user-generated content, including marketplace bot strategies and AI-generated outputs. If you believe content on the Service infringes your copyright, send a written notice containing the information required by 17 U.S.C. § 512(c)(3) to our designated DMCA agent:

Your notice must include:
- A physical or electronic signature of the copyright owner or their authorized agent
- Identification of the copyrighted work claimed to have been infringed
- Identification of the allegedly infringing material, with sufficient detail to allow us to locate it
- Your contact information (address, telephone, and email)
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
We will respond to valid DMCA notices in accordance with applicable law and may, at our discretion, remove or disable access to allegedly infringing content. We will terminate the accounts of repeat infringers. Counter-notifications may be sent to the same agent and must contain the information required by 17 U.S.C. § 512(g)(3).
36. Force Majeure
PredictEngine shall not be liable for any failure or delay in performance under these Terms resulting from causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, civil unrest, government action, embargoes, sanctions, pandemics, public-health emergencies, labor disputes, internet or telecommunications outages, third-party platform failures (including Polymarket, Opinion, Polygon, BNB Chain, or any RPC provider), blockchain forks or reorganizations, exchange or bridge halts, smart-contract exploits, cyberattacks (including denial-of-service), or supply-chain interruptions affecting cloud infrastructure providers.

Formal legal notices to PredictEngine — including subpoenas, formal legal correspondence, and notices required by these Terms — must be sent in writing to:

Notices sent by any other means (including direct messages, social media replies, or replies to automated emails) are not effective service of legal process and may not be reviewed.
38. Assignment; No Third-Party Beneficiaries
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempted assignment without consent is void. PredictEngine may assign these Terms at any time, including in connection with a merger, acquisition, financing, or sale of all or substantially all of its assets.
These Terms are for the benefit of you and PredictEngine only. No other person or entity is a third-party beneficiary of these Terms.
BY USING PREDICTENGINE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
